2. PERSONAL DATA PROCESSING POLICY

In compliance with Law 1581 of 2012 and Decree 1377 of 2013 of the Republic of Colombia, which regulate the protection of personal data, GesFlow Tech establishes this policy for the collection, storage, use, circulation, and deletion of personal data.

2.1. Purpose of Data Collection

The personal data provided by Users (Clients) and the data processed through WhatsApp conversations of their end users will be used to:

  • Provide automated assistance services and responses using Artificial Intelligence (AI).
  • Generate quotes, schedule appointments in Google Calendar, and capture leads.
  • Handle billing, technical support, and send service notifications.
  • Improve language model performance and analyze interactions (in an anonymized manner when applicable).

2.2. Rights of Data Subjects (Habeas Data)

As the owner of your personal data, you have the right to:

  • Know, update, and rectify your personal data held by GesFlow Tech.
  • Request proof of the authorization granted for the processing of your data.
  • Be informed about the use given to your personal data.
  • Revoke the authorization and/or request data deletion when the processing does not respect constitutional and legal principles, rights, and guarantees.

To exercise these rights, you can send a formal request to the contact email mentioned in section 1.

2.3. Data Deletion Instructions

In accordance with Meta (Facebook) regulations and current legislation, any user (end client or administrator) has the right to request the total and permanent deletion of their personal data, chat history, and platform settings.

To request the deletion of your data, follow these steps:

  1. Send an email with the subject "Data Deletion Request".
  2. Address the email to both of the following addresses: resuelvo@lmentaltech.com and gesflowtech@gmail.com.
  3. Include in the body of the message the phone number (with country code) or the email address associated with the data you want to be deleted.

Once the request is received, we will process the deletion of your information from our databases within a maximum of 7 business days and send you a confirmation email of successful deletion.

3. TERMS AND CONDITIONS OF SERVICE

3.1. Nature of the Service

GesFlow Tech provides a Software as a Service (SaaS) platform that allows integrating Artificial Intelligence (RAG - Retrieval-Augmented Generation) into communication channels such as WhatsApp (via Twilio or Meta Cloud API) to automate customer service. The User is solely responsible for the information (PDFs, docs, rules) used to train the bot.

3.2. Use of Third-Party Technologies and APIs

The operation of GesFlow Bot depends on Application Programming Interfaces (APIs) provided by third parties, including but not limited to: Meta (WhatsApp Cloud API), Twilio, OpenAI, Google (Gemini, Google Calendar). GesFlow Tech is not responsible for service outages, phone number blocks, commercial account bans due to non-compliance with WhatsApp commerce policies, or changes in the pricing structures implemented by these API providers.

3.3. Limitation of Artificial Intelligence (AI) Liability

Although our RAG technology is designed to avoid "hallucinations" and strictly restrict responses to the provided documentation, Artificial Intelligence may occasionally generate inaccurate or out-of-context responses. GesFlow Tech is not responsible for financial losses, erroneous commercial commitments, loss of sales opportunities, or any damage derived from a response generated by the bot. It is the User's responsibility to monitor conversations through the Dashboard and take human control when necessary.

3.4. User (Client) Obligations

  • Lawful Content: The user agrees not to use the bot for the sale of illegal products, sending massive spam, distributing fraudulent content, or any activity that violates Colombian laws or WhatsApp Commerce Policies.
  • End Customer Privacy: The User acts as the primary Data Controller of their customers' database. By using GesFlow, the User guarantees that they have the authorization of their customers (consumers) to collect their phone numbers and data via WhatsApp.
  • Payments: Failure to pay the subscription fees (e.g., Starter Plan) will empower GesFlow Tech to suspend or cancel access to the platform without prior notice.

3.5. Intellectual Property

The source code, platform design, internal algorithms (except those provided by third parties), interfaces, and logos are the exclusive property of Gestalt Tech Group. The user is granted a temporary and non-transferable license of use subject to the payment of their subscription, which does not include rights to the underlying software.

4. POLICY CHANGES

GesFlow Tech reserves the right to modify these Terms and Conditions, as well as its Data Processing Policy, at any time. Modifications will take effect upon publication on this page. It is the User's responsibility to periodically review this section.
